- Primero. REVOCAR el fallo de 12 de septiembre de 2000, dictado por el Juzgado Doce Laboral del Circuito de Medellín, para en su lugar TUTELAR los derechos fundamentales a la vida y al mínimo vital del accionante GUSTAVO ACOSTA PALACIO.
- Segundo. ORDENAR, en consecuencia, al titular de la Gerencia del "CAP LA 33, Seccional Antioquia", del Instituto de Seguro Social, que en el término de cuarenta y ocho (48) horas siguientes a la notificación de este fallo, haga llegar, si es que no lo ha hecho, al Ministerio de Hacienda y Crédito Público, la certificación o anulación de la historia laboral del señor GUSTAVO ACOSTA PALACIO, previniendo al funcionario para que esté atento a que el trámite subsiguiente del caso se consolide oportunamente, en orden a que dicho Ministerio, dentro del término que no podrá exceder de un (1) mes, ponga a disposición del Instituto de Seguro Social el bono pensional necesario para atender la solicitud formulada por el señor ACOSTA PALACIO.
- Tercero. ORDENAR que por Secretaría se líbrese la comunicación prevista por el artículo 36 del decreto 2591 de 1991 para los fines allí indicados.
