- Primero. CONFIRMAR los ordinales primero,

- cuarto. de la sentencia de fecha 3 de diciembre de 1996 de la Sala Penal de Decision del Tribunal Superior de Bucaramanga.
- Segundo. CONFIRMAR el ordinal
- segundo. de la referida sentencia, en el sentido de ordenar la nulidad de todo lo actuado en este proceso a partir del auto de fecha noviembre 19 de 1996 inclusive, por medio del cual se elevo pliego de cargos al demandante. Pero se revoca en cuanto resolvio dejar en firme y de manera definitiva la orden provisional de inejecucion de la suspension en el cargo dispuesta en el auto de 26 de noviembre de 1996 de dicho Tribunal. En consecuencia, la orden de suspension provisional debe ser cumplida.
- Tercero. ORDENAR que por la Secretaria General de esta Corporacion, se comunique esta providencia al Tribunal Superior de Bucaramanga, en la forma y para los efectos previstos en el articulo 36 del decreto 2591 de 1991.
