- PRIMERO. CONFIRMAR la sentencia de la Corte Suprema de Justicia, de fecha 26 de abril de 1994. En consecuencia, no se concede la tutela demandada por el señor RICARDO JOSE ALARCON NUÑEZ.
- SEGUNDO. Enviar copia de esta sentencia al Instituto Colombiano de Bienestar Familiar para que, si lo considera pertinente, adopte medidas en defensa del menor mencionado.
- TERCERO. Comunicar la presente sentencia al Tribunal Superior del Distrito Judicial de Santafé de Bogotá, para que sea notificada a las partes, de conformidad con lo dispuesto en el artículo 36 del decreto 2591 de 1991.
