Derecho al debido proceso, trabajo y asociacion sindical de miembros de la union sindical obrera que fueron despedidos despues de realizado un proceso disciplinario en el cual se los hallo responsables de infringir la constitucion, ciertas leyes y el reglamento interno de la empresa, por no haber asistido al trabajo durante los dias en los cuales el sindicato promovio un cese de funciones.
Se declaron improcedentes sendas tutelas por verificarse la existencia de dos proceso, uno de simple nulidad y otro laboral ante la seccion segunda de la sala de lo contencioso administrativo del consejo de estado y la jurisdiccion del trabajo, respectivamente.
Ademas, no se constato la ocurrencia de una situacion tal que generara un perjuicio irremediable.

- Segundo. Civil del Circuito de Barrancabermeja, dentro de las acciones de tutela instauradas por Alexander Del Cristo Lopez -T-1.630.257-y Angel de Jesus Diaz Rodriguez -1.687.820- respectivamente, contra ECOPETROL S.A. y la Oficina de Control Disciplinario Interno de la misma entidad.
- Segundo. Librese la comunicacion Librense por Secretaria las comunicaciones de que trata el articulo 36 del Decreto 2591 de 1991.
