- REVOCAR la sentencia dictada por el Juzgado
- Primero. Civil del Circuito de Ibague, el catorce (14) de febrero de 1997, dentro del proceso promovido por el accionante Alvaro Rodriguez Villanueva contra el Fondo Nacional de Prestaciones Sociales del Magisterio, Regional Tolima, por las razones anotadas en la parte motiva de esta providencia.
- En su lugar se dispone :
- Primero. TUTELAR el derecho del demandante senor Alvaro Rodriguez Villanueva a continuar disfrutando de la sustitucion pensional a el reconocida, a partir de la fecha en que le fue suspendida, siempre que con anterioridad a la notificacion de esta providencia no se le hayan pagado las mesadas pensionales dejadas de percibir, hasta tanto la jurisdiccion competente decide la controversia en relacion con el derecho al pago de las mismas.
- Segundo. PREVENIR al Fondo Nacional de Prestaciones Sociales del Magisterio, Regional Tolima, para que se abstenga de volver a realizar actos como los relacionados en este proceso sobre suspension unilateral del pago de mesadas pensionales.
- Tercero. LIBRENSE por Secretaria, las comunicaciones de que trata el articulo 36 del decreto 2591 de 1991.
