- Primero. , REVOCAR la sentencia proferida por el Juzgado
- Primero. Civil del Circuito de Espinal, el día veintiséis (26) de enero de mil novecientos noventa y nueve (1999), y en su lugar CONCEDER la tutela del derecho de petición de la señora Herlinda Nieto viuda de Cárdenas, contra la Caja Nacional de Previsión Social.
- Segundo. ORDENAR a la Caja Nacional de Previsión Social, que en el término de 48 horas contados a partir de la notificación de la presente providencia si aún no lo ha hecho, proceda a resolver de fondo las petición elevada por la señora Herlinda Nieto viuda de Cárdenas.
- Tercero. ORDENAR que por Secretaria General se compulsen copias del presente proceso a la Procuraduría General de la Nación y al Defensor del Pueblo, en atención a lo ordenado en la sentencia T-068 de 1998.
- Cuarto. LÍBRENSE las comunicaciones previstas en el artículo 36 del Decreto 2591 de 1991.
