PRIMERO. REVOCAR la Sentencia proferida por el Juzgado
Primero. Laboral del Circuito de Florencia, el día diecisiete (17) de junio de mil novecientos noventa y tres (1993), y en su lugar CONCEDER la tutela respecto del derecho de petición que en vida ejerció el señor OCTAVIO CARVAJAL CABRERA. En consecuencia, la CAJA DE PREVISIÓN SOCIAL MUNICIPAL DE FLORENCIA deberá, dentro del término de diez (10) días proceder a dictar la resolución a que haya lugar, la que debe acreditar ante el Juzgado
Primero. Laboral del Circuito de Florencia.
Segundo. Se PREVIENE al Gerente de la CAJA DE PREVISION SOCIAL MUNICIPAL DE FLORENCIA para que tome las medidas correspondientes, a fin de que la entidad a su cargo no vuelva a incurrir en actuaciones como las que motivaron el ejercicio de la presente acción.
Tercero. Ordénase que por Secretaría General se remitan copias a la Procuraduría General de la Nación para que proceda de conformidad con lo expuesto en la parte motiva de esta providencia.
LIBRENSE por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991 para los efectos allí contemplados.
