Primero. REVOCAR la sentencia proferida el 15 de diciembre de 1998, por el Juzgado Penal Municipal de Salamina (Caldas), la cual negó la presente tutela. En su lugar TUTELAR el derecho al trabajo.
Segundo. ORDENAR al Alcalde Municipal de Salamina (Caldas) para que en el término de cuarenta y ocho (48) horas, contadas a partir de la notificación del presente fallo, proceda a pagar los salarios al señor Carlos Ariel Palacio Hernández, siempre y cuando exista la debida partida presupuestal. Si esta no existiere o fuere insuficiente, dispondrá del término ya señalado para iniciar las gestiones tendientes a obtener los recursos necesarios para el pago efectivo y completo de lo ya ordenado.
Tercero. LÍBRENSE por la Secretaría General de esta Corporación, las comunicaciones de que trata el artículo 36 del decreto 2591 de 1991.
