Primero. REVOCAR el fallo proferido por el Juzgado
Segundo. Promiscuo del Circuito de San Juan del Cesar y en su lugar, CONFIRMAR en todas sus partes la sentencia del Juzgado Civil Municipal de dicha ciudad, que tuteló los derechos a la seguridad social, la dignidad de la persona humana y al mínimo vital del señor Tomás David Ramírez Guerra.
Segundo. ORDENAR al señor Alcalde Municipal del Municipio de San Juan del Cesar (Guajira), que si no lo hubiere hecho ya, en el término de cuarenta y ocho (48) horas contadas a partir de la notificación de la presente providencia, proceda a dar cumplimiento al fallo proferido por el Juzgado Civil Municipal de esa ciudad. En caso de que no disponga de los recursos, dentro del término indicado deberá iniciar los trámites o acciones necesarias para obtenerlos y cumplir la obligación dentro del término de tres meses a partir de la notificación de la presente providencia.
Tercero. El desacato a lo ordenado en esta providencia, se sancionará de conformidad con lo señalado en el artículo 52 del Decreto 2591 de 1991.
Cuarto. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
