Primero. REVOCAR los fallos proferidos por la Sala Laboral del Tribunal Superior de Bogotá del 29 de octubre de 1997 y por la Sala de Casación Laboral de la Corte Suprema de Justicia del 3 de diciembre del mismo año.
Segundo. CONCEDER la tutela del derecho de petición y en consecuencia, ORDENAR a la CAJA NACIONAL DE PREVISION, que en el término de cuarenta y ocho (48) horas contadas a partir de la notificación de esta sentencia, resuelva definitivamente las peticiones elevadas por la señora MARÍA ELENA MARTÍNEZ ROMERO, y responda de manera clara y definitiva sobre quién tiene la competencia para reconocer su pensión de jubilación.
Tercero. CONMINAR al INSTITUTO DE LOS SEGUROS SOCIALES , para que revise la documentación presentada por la actora y en el término de cuatro (4) días, contados a partir de la notificación de este fallo, decida definitivamente sobre la competencia para reconocer la pensión de jubilación de la señora María Elena Martínez Romero.
Cuarto. ORDENAR a ambas Instituciones que hagan saber de sus decisiones a la demandante.
Quinto. Líbrense las comunicaciones previstas en el artículo 36 del decreto 2591 de 1991 para los fines allí contemplados.
