Petición.
A la accionante le fue reconocida su pensión de vejez, comenta que radicó un derecho de petición ante el ISS solicitando información acerca del trámite de reliquidación y pago del retroactivo pensional, sin embargo la entidad accionada no ha emitido respuesta alguna.
La Sala, realiza reiteración de jurisprudencia sobre el derecho de petición en materia pensional, se decide conceder la acción y se ordena al ISS responder la petición de reliquidación y pago de retroactivo.

- Primero. REVOCAR el fallo unico de instancia proferido, en julio 22 de 2010, por el Juzgado Cuarenta y Dos Civil del Circuito de Bogota, que nego el amparo solicitado por la senora Blanca Stella Garcia Leon; en su lugar, se dispone TUTELAR el derecho fundamental de peticion.
- Segundo. ORDENASE al Instituto de Seguros Sociales, ISS, seccional Cundinamarca y Bogota D. C., por intermedio del Jefe del Departamento de Pensiones, o quien haga sus veces, que si aun no lo ha hecho, en el termino de cuarenta y ocho (48) horas siguientes a la notificacion de esta sentencia, responda la peticion de reliquidacion y pago del retroactivo pensional de la senora Blanca Stella Garcia Leon, radicada en junio 29 de 2010.
- Tercero. Por Secretaria General, LIBRESE la comunicacion a que alude el articulo 36 del Decreto 2591 de 1991.
