en nombre del pueblo y por mandato de la Constitucion,
R E S U E L V E :
PRIMERO. REVOCAR el fallo proferido por el Juzgado
Primero. Penal Municipal de Sandona (Narino), el dia nueve (9) de noviembre de mil novecientos noventa y cinco (1995), y en su lugar RECHAZAR por improcedente la accion de tutela interpuesta por Guillermo Javier Narvaez Paz, contra el Municipio de Sandona.
SEGUNDO. ORDENAR LA DEVOLUCION, en el termino de 48 horas siguientes a la notificacion de este fallo, de las sumas de dinero pagadas en acatamiento al fallo que se revoca.
TERCERO. LIBRENSE por Secretaria las comunicaciones de que trata el articulo 36 del Decreto 2591 de 1991, para los efectos alli contemplados.
