- Primero. REVOCAR los fallos proferidos en segunda instancia por la Sala Laboral de la Corte Suprema de Justicia, mediante los cuales se negó el amparo invocado. En su lugar, proteger el derecho de asociación sindical de los accionantes.
- Segundo. ORDENAR a las Empresas Públicas de Bucaramanga S.A. E.S.P. que, a más tardar dentro de las cuarenta y ocho (48) horas siguientes a la notificación del presente Fallo, proceda al reintegro de los actores, en cargos de igual o superior categoría a los que venían desempeñando cuando se produjo la terminación unilateral de los contratos.
- Lo concerniente a controversias económicas por concepto de salarios y prestaciones, compensaciones o indemnizaciones, deberá ventilarse ante los jueces laborales, los cuales, en todo caso, en cuanto concierne a la protección constitucional que se concede, no podrán desconocer, ignorar ni inaplicar lo dispuesto en este Fallo".
- Tercero. Dar cumplimiento a lo dispuesto en el artículo 36 del Decreto 2591 de 1991.
