- Primero. REVOCAR la sentencia de fecha 12 de junio del 2000, proferida por el Tribunal Contencioso Administrativo del Valle del Cauca. En su lugar, conceder la accion de tutela solicitada por el actor, a los derechos fundamentales a la vida, salud y seguridad social.
- Segundo. INAPLICAR en el presente caso, por ser incompatible, el paragrafo 12 de la Resolucion No. 5261 de 5 de agosto de 1994, emanada del Ministerio de Salud, o las disposiciones que en el mismos sentido, la hayan sustituido.
- Tercero. CONCEDER al amparo solicitado y ordenado al ISS-Seccional Cali (Valle del Cauca), que dentro de las 48 horas siguientes a la notificacion de las providencias entregue al actor los medicamentos requeridos y ordenados por el medico tratante: Akineton-Sinemet-Selegil y Celance.
- Cuarto. Declarar que la EPS del ISS tiene derecho a repetir contra el Ministerio de Salud - Fondo de Solidaridad y Garantias (FOSYGA), para que este reembolse el valor de los medicamentos suministrados al actor , en cumplimiento de este fallo.
- Quinto. Por Secretaria general, librense las comunicaciones previstas en el articulo 36 del decreto 2591 de 1991, para los efectos alli contemplados.
