Primero. REVOCAR el fallo proferido por el Tribunal Superior de Distrito Judicial de Bogotá, D.C. Sala Penal, del dos (2) de mayo de dos mil (2000). Y en consecuencia, TUTELAR los derechos fundamentales a la vida, salud y seguridad social del actor.
Segundo. ORDENAR a COMPENSAR E.P.S. que en el término de DIEZ (10) días contados a partir de la notificación del presente fallo, suministre la droga formulada al actor.
Tercero. SEÑALAR a COMPENSAR E.P.S. que puede repetir los sobrecostos en que incurra cumpliendo ésta orden, en contra del Fondo de Solidaridad y Garantía del Sistema de Seguridad Social Integral en salud.
Cuarto. Por Secretaría, LÍBRESE la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
