Primero. REVOCAR las sentencia proferida por el Juzgado
Cuarto. Civil del Circuito de Bogotá, que negó la protección del derecho reclamado por la señora FABIOLA DURAN RESTREPO. En su lugar, TUTELAR el derecho de petición.
Segundo. ORDENAR al Seguro Social, que si aún no lo ha hecho, dentro de las cuarenta y ocho (48) horas siguientes a la notificación de esta providencia proceda a pronunciarse de fondo sobre el objeto de la petición elevada por la señora Fabiola Durán Restrepo.
Tercero. PREVENIR al Seguro Social para que en el futuro se abstenga de incurrir en actuaciones que vulneran los derechos fundamentales de sus afiliados.
Cuarto. Por Secretaría, líbrense la comunicación de que trata el artículo 36 del decreto 2591 de 1991
