- Primero. REVOCAR los fallos proferidos por el Juzgado
- Octavo. Laboral del Circuito de Barranquilla y la Sala Laboral del Tribunal Superior de esa misma ciudad, mediante los cuales negaron la tutela interpuesta por LIBIA RESTREPO CASTAÑO contra la empresa T&S TEMPORALES Y SYSTEMPORA LTDA.
- Segundo. En su lugar CONCEDER la tutela interpuesta por la actora para proteger sus derechos a la igualdad, a la protección especial de la madre y al mínimo vital de la demandante y su hijo.
- Tercero. ORDENAR a la accionada T&S TEMPORALES Y SYSTEMPORA LTDA., dar cumplimiento inmediato a lo dispuesto en el artículo 239 del C.S.T. y en la sentecia de esta Corporación distinguida con el número C-470 de 25 de septiembre de 1997 (M.P. Dr. Alejandro Martínez Caballero)
- Lo ordenado debe cumplirse -so pena de la aplicación de las sanciones previstas en el artículo 52 del Decreto 2591 de 1991- dentro de las cuarenta y ocho (48) horas siguientes a la notificación de este Fallo.
- Cuarto. Por Secretaria General, líbrense las comunicaciones previstas en el artículo 36 del Decreto 2591 de 1991, para los efectos allí previstos.
