- Primero. REVOCAR las sentencias proferidas por el TRIBUNAL CONTENCIOSO ADMINISTRATIVO DEL VALLE DEL CAUCA, el 23 de febrero de 2000, despacho que negó por improcedente la acción de tutela instaurada por JOSÉ DE LA EXPECTACIÓN MULETT CHAVEZ contra la UNIVERSIDAD DEL VALLE y el fallo de LA SALA DE LO CONTENCIOSO ADMINISTRATIVO DEL CONSEJO DE ESTADO, fechado el 27 de abril del año 2000 que confirmó el del a-quo. En su lugar, CONCEDER el amparo solicitado, en los términos expresados en la parte motiva de esta providencia.
- Segundo. En consecuencia, ORDENAR al rector de la Universidad del Valle o quien haga sus veces, que en el término de las cuarenta y ocho (48) horas siguientes, contadas a partir de la notificación de este fallo, inicie los trámites y gestiones necesarias, si es que durante el trámite de revisión ya no los hubiere hecho, para obtener los recursos que le permitan garantizar el pago oportuno de las mesadas pensionales a las que pueda tener derecho el actor, en las nóminas futuras.
- Tercero. SOLICITAR al Gobierno Nacional, a través de los Ministerios de Educación y Hacienda, así como a la administración departamental del Valle del Cauca, que presten su inmediata colaboración, a efectos de buscar una solución a la crisis por la que está atravesando la Universidad del Valle. ENVÍESELES copia de este fallo.
- Cuarto. Por Secretaría General, LÍBRENSE las comunicaciones a que se refiere el artículo 36 del decreto 2591 de 1991.
