- Primero. REVOCAR el fallo proferido por el Juez Quince Civil del Circuito de Medellin el 4 de septiembre de 2001, en el que se inhibio para pronunciarse de fondo respecto de la tutela de la referencia.
- Segundo. CONFIRMAR el fallo proferido por el Juzgado
- Octavo. Civil Municipal de Medellin el 18 de julio de 2001. En consecuencia, TUTELAR el derecho fundamental al debido proceso administrativo de la accionante respecto de la prestacion del servicio publico de seguridad social en salud.
- Tercero. ORDENAR a la A.R.P. Suratep S.A. que si no ha determinado, en segunda instancia, el origen de la patologia que presenta la accionante en el proceso de la referencia, senora Beatriz Helena Pineda, proceda a hacerlo dentro de las 48 horas siguientes a la notificacion del presente fallo.
- Cuarto. ENVIAR copia del expediente y de esta providencia al Consejo Seccional de la Judicatura de Antioquia para lo de su competencia.
- Quinto. Por Secretaria, librese la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991.
