- Primero. REVOCAR el fallo proferido por el Juzgado
- Primero. de Familia de Cali, el veintiuno (21) de octubre de 1996, que denego la tutela formulada por Olga Clemencia Hincapie Arias, en contra de la Cooperativa Medica del Valle y de los Profesionales de Colombia, "COOMEVA", por las razones expuestas en la parte motiva de esta providencia.
- Segundo. CONCEDER la tutela del derecho fundamental a la vida y a la salud, y en consecuencia, ordenar a la Cooperativa Medica del Valle y de los Profesionales de Colombia "COOMEVA" que, en el plazo maximo de cuarenta y ocho (48) horas, contado a partir de la notificacion de este fallo, autorice la cirugia a la senora Olga Clemencia Hincapie Arias y adelante los tramites que sean necesarios para que la intervencion quirurgica que de que trata la presente providencia, se realice en el menor tiempo posible con cargo a la entidad accionada.
- Tercero. LIBRENSE por secretaria, las comunicaciones de que trata el articulo 36 del decreto 2591 de 1991.
