- Tercero. Penal del Circuito de Ibagué, mediante la cual decidió CONFIRMAR el fallo dictado por el Juzgado
- Quinto. Penal Municipal de Ibagué, y en su lugar TUTELAR el derecho fundamental al debido proceso de Mónica Andrea Torres Silva.
- Segundo. Dejar sin efecto la sanción impuesta a la menor Mónica Andrea Torres Silva y ORDENAR al Colegio Departamental Santa Teresa de Jesús de Ibagué que, a más tardar dentro de las cuarenta y ocho (48) horas siguientes a la notificación del fallo, inicie de nuevo el proceso disciplinario contra la mencionada menor y que, en el curso de aquél, dé estricto cumplimiento al Manual de Convivencia y al articulo 319 del Código del Menor (Decreto 2737 de 1989), con el fin de no violar el derecho al debido proceso.
- Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
