- Primero. REVOCAR la sentencia proferida por el Juzgado
- Octavo. Civil del Circuito de Bogota, del 26 de noviembre de 1998. En su lugar TUTELAR los derechos fundamentales a la salud y a la vida de la senora Maria Patricia Hernandez Garcia.
- Segundo. ORDENAR a HUMANA S.A., compania de Medicina Prepagada realizar a la senora Maria Patricia Hernandez Garcia la intervencion quirurgica denominada miomectomia, cirugia que se debera realizar dentro de los quince (15) dias siguientes a la notificacion de la presente sentencia. con cargo al contrato de medicina prepagada.
- Tercero. LIBRENSE las comunicaciones de que trata el articulo 36 del Decreto 2591 de 1991, para los efectos alli contemplados.
