La vulneración de derechos fundamentales se predica del reclutamiento del accionante para la prestación del servicio militar obligatorio, a pesar de encontrarse estudiando y con problemas de salud.
Se solicita el desacuartelamiento y la expedición de la respectiva libreta militar.
La Sala de Revisión concluye que la acción de tutela resulta IMPROCEDENTE, porque no se evidenció que el demandante o su agente oficioso realizaran solicitud de desacuartelamiento ante la autoridad competente, petición que resulta necesaria para que el juez constitucional determine si existió o no una conducta vulneratoria de derechos fundamentales.
