Primero. Confirmar, pero por las razones expuestas en este pronunciamiento, la sentencia de primera instancia proferida el 10 de septiembre de 2002 por el Juzgado Catorce Civil Municipal de Bogotá y revocar la sentencia de segunda instancia proferida el 21 de octubre de 2002 por el Juzgado Cuarenta Civil del Circuito de Bogotá.
Segundo. Tutelar el derecho fundamental al debido proceso de Juan Manuel Vargas Becerra en el proceso de lanzamiento por ocupación de hecho promovido en su contra. Anular ese proceso a partir de la sentencia de segunda instancia proferida el 30 de mayo de 2002 por la Sala Civil del Consejo de Justicia de Bogotá y ordenar a esa autoridad de policía que, en las 48 horas siguientes a la notificación de este pronunciamiento, profiera una sentencia con estricto apego a la Constitución y a la ley.
Tercero. DÉSE cumplimiento a lo dispuesto en el artículo 36 del Decreto 2591 de 1991.
