- Primero. REVOCAR la sentencia de primera instancia proferida el 10 de septiembre de 2002 por el Juzgado Catorce Civil Municipal de Bogota y CONFIRMAR la sentencia de segunda instancia proferida el 21 de octubre de 2002 por el Juzgado Cuarenta Civil del Circuito de Bogota.
- Segundo. No tutelar los derechos al debido proceso, al acceso a la administracion de justicia y a la vivienda digna de Juan Manuel Vargas Becerra.
- Tercero. DESE cumplimiento a lo dispuesto en el articulo 36 del Decreto 2591 de 1991.
