- en nombre del pueblo y por mandato de la Constitucion,
- R E S U E L V E :
- PRIMERO. Declarar EXEQUIBLE, por las razones expuestas en esta providencia, el inciso
- tercero. del articulo 1o. de la ley 78 de 1986 que preve: "Los Alcaldes de distrito, de capitales de departamento, se denominaran Alcaldes Mayores", con excepcion de la expresion "de capitales de departamento" que se declara INEXEQUIBLE. En consecuencia, es entendido que dicha denominacion solo corresponde a los alcaldes de Santafe de Bogota, Cartagena de Indias y Santa Marta.
- SEGUNDO. INHIBIRSE de fallar en el fondo en relacion con la pretension de nulidad, por presunta inconstitucionalidad de los actos administrativos proferidos por el senor alcalde municipal de la ciudad de Santiago de Cali, con fundamento en la norma antes citada.
