- Primero. DECLARAR EXEQUIBLE los apartes acusados de los artículos 75 y 79 de la Ley 42 de 1993.
- Segundo. DECLARAR EXEQUIBLE el aparte final del artículo 101 de la Ley 42 de 1993 que dice: "y cuando a criterio de los contralores exista mérito suficiente para ello", bajo el entendido de que en dicha expresión no se consagra una causal autónoma para aplicar sanciones, sino una regla que deben seguir dichos contralores para imponerlas.
