- Primero. DECLARAR EXEQUIBLE la Ley 279 del 13 de mayo de 1995, "por medio de la cual se aprueba el Convenio entre el Gobierno de la Republica de Colombia y el Gobierno de la Republica del Peru sobre Promocion y Proteccion Reciproca de Inversiones, suscrito en lima el 26 de abril de 1994."
- Segundo. DECLARAR EXEQUIBLE el Convenio entre el Gobierno de la Republica de Colombia y el Gobierno de la Republica del Peru sobre Promocion y Proteccion Reciproca de Inversiones, suscrito en lima el 26 de abril de 1994", salvo el articulo 7o del mismo, el cual se declara INEXEQUIBLE, conforme a lo expuesto en la parte motiva de esta sentencia.
- De conformidad con lo dispuesto en el articulo 241, numeral 10, de la Constitucion Politica, el Presidente de la Republica, al manifestar el consentimiento de Colombia en obligarse por el Tratado, unicamente podra ratificar las clausulas del mismo que, segun esta Sentencia, se ajustan a la Constitucion Politica.
- Tercero. De acuerdo con lo advertido en la parte motiva de esta providencia, las clausulas de tratamiento nacional y de la Nacion mas favorecida, contenidas en el Convenio bajo examen, quedan sujetas a las restricciones que el articulo 100 de la Constitucion consagra para el ejercicio de los derechos de los extranjeros.
- Solo en este sentido podra manifestar el Gobierno el consentimiento del Estado en obligarse por el Tratado.
