PRIMERO. REVOCAR los fallos del Juzgado
Noveno. Civil Municipal de Medellín con fecha 07 de marzo de 2003 y el Juzgado
Séptimo. del Circuito de Medellín con fecha 8 de mayo de 2003. Y en consecuencia, CONCEDER la tutela solicitada por el señor CONSTANTINO OBANDO ESCOBAR, por las razones expuestas en la parte motiva de este fallo.
SEGUNDO. INAPLICAR de conformidad con el artículo 4º de la Constitución Política y para el caso específico el parágrafo del artículo 12 de la Resolución 5261 de 1994, emitida por el Ministerio de Salud y el artículo 7º del Acuerdo 08 de 1994 del Consejo Nacional de Seguridad Social en Salud.
TERCERO. ORDENAR a la EPS de HUMANA VIVIR de Medellín que dentro del término de cuarenta y ocho (48) horas contadas a partir de la comunicación del presente fallo, proceda a ordenar el implante de Stent al señor CONSTANTINO OBANDO ESCOBAR.
CUARTO. AUTORIZAR a la EPS de HUMANA VIVIR de Medellín a repetir contra el FOSYGA, por el recobro de los dineros invertidos en el implante de Stent.
QUINTO. LÍBRESE por Secretaría las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
