- Primero. CONFIRMAR el fallo proferido el treinta (30) de marzo de dos mil uno (2001), por el Juzgado 5 Civil del Circuito de Cartagena, dentro de la accion de tutela instaurada por el senor Pablo Enrique Macias Correa contra la Alcaldia Distrital de Cartagena de indias, por las razones expuestas en la parte motiva de este fallo.
- Segundo. Advertir al senor Alcalde Distrital de Cartagena o al funcionario que este delegue para la practica de la diligencia de lanzamiento por ocupacion de hecho a que se refiere esta accion de tutela, que durante ella habran de respetarse la dignidad personal de los ocupantes, con especial esmero respecto de los ancianos y los ninos que se encuentren en el inmueble.
- Tercero. Por Secretaria General, librense las comunicaciones de que trata el articulo 36 del decreto 2591 de 1991.
