- Primero. CONFIRMAR la sentencia del Juzgado Civil del Circuito de Istmina de fecha 24 de julio de 1996, mediante la cual se revoco la sentencia del Juzgado Promiscuo Municipal de Condoto del 27 de mayo de 1996, que habia concedido la tutela impetrada.
- Segundo. ORDENAR al Alcalde Municipal de Condoto proceda a solucionar el problema suscitado con motivo de la vinculacion del docente Candido Rivas Mosquera al Liceo Municipal Academico de Bachillerato Nocturno "Neftali Lozano Osorio", bien reubicandolo en otro plantel educativo, o si lo estima conveniente suprimiendo el cargo, todo ello con arreglo a las formalidades legales. Igualmente se advierte a dicha autoridad, que la conducta observada por el referido docente eventualmente puede ser constitutiva de faltas disciplinarias que ameritan el tramite del correspondiente proceso disciplinario.
- Tercero. COMUNICAR, a traves de la Secretaria General de la Corte Constitucional, el contenido de la presente sentencia al Juzgado Promiscuo Municipal de Condoto, con el fin de que proceda a dar cumplimiento a lo dispuesto en el art. 36 del decreto 2591 de 1991.
