- Primero. REVOCAR la sentencia del juzgado
- primero. penal municipal de Chiquinquira y, en su lugar, conceder la tutela como mecanismo transitorio, en los terminos de esta sentencia.
- Segundo. ORDENAR al Ejercito Nacional que, en el termino de cuarenta y ocho (48) horas siguientes a la notificacion de esta providencia proceda a efectuar el pago del 50% de los salarios a que tiene derecho el sargento Pedro Jose Guarnizo Ovalle.
- Tercero. La demandante debera, en el termino de cuatro (4) meses contados a partir de la notificacion de la presente sentencia, iniciar los tramites necesarios para declarar ausente, por secuestro, al Sargento Pedro Jose Guarnizo Ovalle. En caso de incumplimiento, cesaran los efectos de la presente sentencia.
- Cuarto. Librense por Secretaria General de esta Corporacion, las comunicaciones de que trata el articulo 36 del decreto 2591 de 1991.
