- Primero. REVOCAR la sentencia proferida por la Sala Civil del Tribunal Superior de Bogotá del 28 de mayo de mil novecientos noventa y ocho.
- Segundo. En su lugar, TUTELAR el derecho fundamental de petición de la señora Nelly Rivera de Rondón. ORDENAR al I.S.S. Departamento de Atención al pensionado de la Seccional Cundinamarca, para que en plazo máximo de cuarenta y ocho (48) horas, contadas a partir de la notificación del presente fallo, resuelva de fondo, sobre la solicitud presentada por la actora y se comunique.
- Tercero. LÍBRENSE por la Secretaría General de esta Corporación, la comunicación de que trata el artículo 36 del decreto 2591 de 1991.
