- PRIMERO. REVOCAR la sentencia de tutela proferida en segunda instancia por el Tribunal Superior del Distrito Judicial de Santafe de Bogota, Sala Civil, el dia 24 de julio de 1995.
- SEGUNDO. CONCEDER la tutela instaurada por Juan Manuel Minaya Molano en contra de la sociedad Datos y Mensajes S.A., propietaria del noticiero TV HOY, por la violacion de sus derechos a la honra y buen nombre.
- TERCERO. ORDENAR al Director del Noticiero TV HOY, que en la emision siguiente a la notificacion del presente fallo se de lectura al siguiente texto: "Por orden judicial, el Noticiero TV HOY presenta la siguiente rectificacion: en la emision del seis (6) de mayo de mil novecientos noventa y cinco, a raiz de unas denuncias conocidas por este noticiero, el periodista Oscar Restrepo pidio la renuncia del Presidente de la Liga de Ajedrez de Bogota, Juan Manuel Minaya Molano. Por la forma en que se presento dicha opinion, se dio a entender equivocadamente que se habia comprobado la veracidad de los hechos denunciados.
- Debemos aclarar que en ningun momento se dio tal comprobacion, y que, al momento de expresar su opinion, Oscar Restrepo no tenia prueba alguna de que Juan Manuel Minaya hubiese incurrido en las actuaciones que se le imputaban".
- CUARTO. Librar la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991.
