- administrando justicia en nombre del pueblo y por autoridad de la Constitución
- R E SU E L V E:
- Primero. REVOCAR la decisión del Tribunal Administrativo de Cundinamarca, de 30 de mayo de 1996, proferida en la acción de tutela de la referencia, en cuanto la rechazó por improcedente. Y, en su lugar CONCEDER parcialmente la acción interpuesta, en el sentido de que se incurrió en una via de hecho por parte del Juzgado 18 Civil del Circuito de Santafé de Bogotá y la Sala Civil del Tribunal Superior de esta ciudad al no cuantificarse el perjuicio moral por parte del juzgador. No son susceptibles de la presente tutela los otros aspectos, ya que se debe respetar la decisión tomada de ubicarlos como lucro cesante y no como daño emergente.
- Segundo. ORDENAR al Juzgado 18 Civil del Circuito de Santafé de Bogotá que proceda a cuantificar los perjuicios morales ocasionados al accionante y ordenados en abstracto por la sentencia de tutela proferida por ese mismo Juzgado y confirmada por el superior.
- Tercero. Para los efectos del artículo 36 del decreto 2591 de 1991 háganse las notificaciones y tómense las prevenciones por el Tribunal Administrativo de Cundinamarca que profirió la decisión de primera instancia en la presente tutela.
