- Primero. REVOCAR las decisiones proferidas por el Tribunal Administrativo de Santander del diecinueve de mayo de 1997 y por la Seccion Primera de la Sala Contencioso Administrativa del Consejo de Estado del veintiseis de junio de este mismo ano, que denego la tutela iniciada por la senora Irma Isabel Ayala Ruiz contra el Hospital Universitario Ramon Gonzalez Valencia de Bucaramanga.
- Segundo. CONCEDER la tutela respecto del derecho de peticion, para lo cual se procede a ORDENAR a la E.P.S. Hospital Universitario Ramon Gonzalez Valencia de Bucaramanga y en particular a su director para que, proceda a resolver de fondo sobre la solicitud presentada, si ya no lo hubiere hecho, dentro de las cuarenta y ocho (48) horas siguientes a la notificacion de la presente sentencia.
- Tercero. ADVERTIR a la entidad aqui demandada que no podra condicionar el reconocimiento de las prestaciones laborales de la demandante a disponibilidad presupuestal, por las razones que se consignan en la parte motiva de esta sentencia.
- Cuarto. SURTASE el tramite previsto en el articulo 36 del Decreto 2591 de 1991.
