Primero. CONFIRMAR las sentencias de segunda instancia proferidas por el Consejo de Estado -Seccion Primera- el 25 de abril de 1996 dentro del expediente T-98282, y por la Corte Suprema de justicia -Sala de Casacion Civil y Agraria- el 31 de mayo de 1994 dentro del expediente T-100917.
Segundo. REVOCAR la sentencia de segunda instancia proferida por el Consejo de Estado -Seccion Tercera- de fecha abril 18 de 1996 que confirmo la expedida por el Tribunal Contencioso Administrativo el 7 de marzo del presente ano y, en su lugar, tutelar el derecho al debido proceso de los demandantes Arturo Infante Villarreal y Ramon Fayad Naffah. En consecuencia, queda sin ningun efecto la providencia del 30 de enero de 1996, proferida por el Tribunal Superior de Santafe de Bogota -Sala Penal- objeto de impugnacion por los demandantes.
Tercero. Declarar igualmente sin efecto la aludida providencia, en relacion con Mauricio Linares Porto.
Cuarto. ORDENAR a la Secretaria General, remitir los expedientes de tutela al Tribunal Administrativo de Cundinamarca y al Tribunal Superior del Distrito Judicial de Santafe de Bogota -Sala Civil- para los efectos del articulo 36 del Decreto 2591 de 1991.
