- Primero. REVOCAR el fallo proferido en segunda instancia, por el Juzgado Civil del Circuito de Ubate - Cundinamarca, el veintisiete de abril (27) de abril de 2009, dentro de la accion de tutela instaurada por Hilda Merida Nino contra La Alcaldia Municipal de Cucunuba.
- Segundo. CONFIRMAR el fallo proferido por el Juzgado Promiscuo Municipal de Cucunuba -Cundinamarca, el doce (12) de marzo de 2009 dentro de la accion de tutela instaurada por Hilda Merida Nino contra La Alcaldia Municipal de Cucunuba por las razones expuestas en esta providencia.
- Tercero. Librese por Secretaria General la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991.
