- Primero. REVOCAR fallo proferido por el Juzgado
- Décimo. Penal Municipal de Medellín, de 14 de marzo de 2002, que negó la protección solicitada a favor del señor José Oscar Hincapié Carmona. En consecuencia, conceder la tutela de los derechos a la salud en conexidad con la vida.
- Segundo. ORDENAR a UNIMEC E.P.S. Que dentro de las cuarenta y ocho (48) horas siguientes a la notificación de este fallo, entregue al señor JOSE OSCAR HINCAPIÉ CARMONA o a quien lo represente, la droga CLOPRIDOGREL 75 mg. de conformidad con las prescripciones de su médico tratante.
- Tercero. DECLARAR que a UNIMEC E.P.S. le asiste el derecho a obtener el reembolso de lo gastado en cumplimiento de la orden emitida por la Sala, en consecuencia, podrá repetir contra la subcuenta correspondiente del Fondo de Solidaridad y Garantía del Sistema de Seguridad Social en Salud.
- Cuarto. Líbrense por Secretaría las comunicaciones de que trata el articulo 36 del Decreto 2591 de 1991.
