- Primero. REVOCAR la providencia de la Corte Suprema de Justicia -Sala de Casación Penal-, el once (11) de junio de 1997 y, en consecuencia, CONFIRMAR la sentencia proferida por el h. Tribunal Superior del Distrito Judicial de Santa Fe de Bogotá -Sala Penal-, el quince (15) de abril del mismo año, por las razones expuestas en este fallo.
- Segundo. ORDENAR que por la Secretaría General de esta Corporación, se comunique esta providencia al h. Tribunal Superior del Distrito Judicial de Santa Fe de Bogotá -Sala Penal- , en la forma y para los efectos previstos en el artículo 36 del Decreto 2591 de 1991.
