- Primero. REVOCAR las sentencias del 1 de octubre de 2001, de la sub-seccion "B" de la Seccion Segunda del Tribunal Administrativo de Cundinamarca y del 22 de noviembre de 2001 de la Seccion Segunda, Subseccion "A" de la Sala de lo Contencioso Administrativo del Consejo de Estado, mediante las cuales se negaron las pretensiones de la demanda.
- segundo. CONCEDER la tutela del derecho al debido proceso, a la igualdad y a la consolidacion de las normas juridicas aplicables del senor Jaime Sgardo Munoz Alfonso. En consecuencia ORDENAR al Departamento Administrativo del Talento Humano de la Gobernacion de Cundinamarca que, en el termino de 48 horas, proceda a dictar una resolucion definitiva, en la cual adopte una decision final sobre la peticion presentada por el demandante el dia 30 de diciembre de 1997, dando aplicacion a las normas por el invocadas.
- Tercero. Por Secretaria, librese la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991.
