- Primero. REVOCAR los fallos proferidos por el Juzgado
- Primero. Laboral del Circuito de Medellin y por la Sala Decima de Decision Laboral del Tribunal Superior de Medellin, en primera y segunda instancia, respectivamente. En su lugar TUTELAR los derechos fundamentales a vida, integridad personal, igualdad, seguridad social y salud de la demandante.
- Segundo. ORDENAR a la empresa Tejidos Leticia Limitada, que en el plazo de cuarenta y ocho (48) horas contadas a partir de la notificacion del presente fallo, proceda a reanudar los pagos de las mesadas pensionales a la senora Flora Rosemblum de Rabinovich. Asi como a afiliarla al Instituto de Seguros Sociales, regimen Salud, si aun no lo ha hecho. En cuanto a las mesadas ya causadas y no pagadas, la demandante podra acudir ante la jurisdiccion ordinaria para exigir su pago.
- Tercero. SOLICITAR al Superintendente de Sociedades verificar el cumplimiento del presente fallo.
- Cuarto. SURTASE el tramite previsto en el articulo 36 del Decreto 2591 de 1991.
