- Primero. REVOCAR el fallo proferido por el Juzgado Cincuenta y Uno Penal Municipal de Bogotá, de noviembre dieciséis (16) de dos mil (2000) que negó la tutela solicitada por Olga María Valencia.
- Segundo. CONCEDER a la demandante Olga María Valencia como mecanismo transitorio para evitar un perjuicio irremediable, la tutela de sus derechos fundamentales a la especial protección constitucional a la maternidad y al mínimo vital. En tal virtud, ORDENAR al demandado Luque Medina y Cia Ltda, que dentro del término de cuarenta y ocho (48) horas contado a partir de la notificación de esta sentencia, reintegre en las mismas condiciones en que fue contratada a la señora Olga María Valencia, sin perjuicio de las demás pretensiones laborales a que pueda tener derecho, las cuales deben ser definidas por la jurisdicción laboral.
- Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
