- PRIMERO. Revócase la sentencia de segunda instancia materia de revisión y en su lugar, concédase la tutela por violación al derecho al trabajo y consecuencialmente ordénase al Instituto Nacional de Vias que en el término de 48 horas hábiles dé cumplimiento a las sentencias de la jurisdicción ordinaria laboral en cuanto se determinó el reintegro del Ricardo García Santamaria al cargo que venía desempeñando al momento del despido o uno de igual o superior categoría. No se tutela en cuanto a los otros pedimentos.
- SEGUNDO. Comuníquese al Juez de primera instancia para las notificaciones y efectos previstos en el artículo 36 del decreto 2191 de 1991.
- TERCERO. El Juez de primera instancia vigilará el cumplimiento de este fallo.
