- Primero. REVOCAR la providencia dictada por la Sala de Decision Penal del Tribunal Superior de Medellin, el 19 de marzo de 1998, que declaro desierta la impugnacion interpuesta por un agente del Ministerio Publico en contra de la sentencia dictada en primera instancia por el Juzgado
- Cuarto. de Ejecucion de Penas y Medidas de Seguridad de Medellin, el 20 de febrero del mismo ano, por medio de la cual se denego la accion de tutela iniciada por Gabriela Quintero Vda. de Betancur contra Susalud E.P.S.
- Segundo. DECLARAR que la tutela de la referencia carece actualmente de objeto, en virtud de lo expuesto en la parte motiva de esta sentencia y de acuerdo con el articulo 24 del decreto 2591 de 1991. En consecuencia, la Sala se abstiene de devolver el expediente al juez de segunda instancia para que se pronuncie de fondo sobre el presente asunto.
- Tercero. LIBRESE por la Secretaria General de esta Corporacion, la comunicacion de que trata el articulo 36 del decreto 2591 de 1991.
