- Primero. Revocar la sentencia del Consejo de Estado de treinta y uno (31) de mayo de mil novecientos noventa y cuatro (1994), y, en su lugar tutelar los derechos al debido proceso, al acceso a la justicia y los derechos de los ninos.
- Segundo. Declarar la nulidad del auto de 30 de agosto de 1993, proferido por la Sala de Familia del Tribunal Superior del Caqueta, mediante el cual se violaron los derechos que por medio de esta providencia se amparan y las demas normas a las que se hizo alusion en la parte motiva.
- Tercero. Ordenar a la Sala de Familia del Tribunal Superior del Caqueta, que proceda a dictar sentencia de fondo sobre la apelacion presentada por la Procuradora 13 Judicial para la Defensa de la Familia y del Menor.
- Cuarto. No se accede a la peticion de condenar al pago de los perjuicios, ni a la cuota alimentaria, por las razones expuestas.
- Quinto. Comunicar esta providencia al Tribunal Administrativo del Caqueta, para los efectos del articulo 36 del Decreto 2591 de 1991.
