- PRIMERO. CONFIRMAR parcialmente la sentencia del siete de abril de 1994 proferida por la Sala Penal del Tribunal Superior de Distrito Judicial de Santa Fe de Bogota en el sentido de conceder la tutela instaurada contra los responsables del Instituto de los Seguros Sociales de la Clinica San Pedro Claver (seccional Cundinamarca), y revocarla en relacion con las ordenes impartidas por los jueces de instancia al medico tratante. En consecuencia, el peticionario tendra derecho a elegir el tratamiento que mas se ajuste a sus condiciones y, de otra parte, el medico podra retirarse de la relacion instaurada con su paciente en el evento de tener objeciones de fondo respecto de la decision tomada por este ultimo, en cuyo caso el Instituto de los Seguros Sociales designara otro medico para la atencion del paciente. En todo caso, el Instituto de los Seguros Sociales debera proveer los recursos, tanto medicos como asistenciales, que fueren necesarios para que el senor Leovani Amador Burgos pueda recibir el tratamiento que elija.
