- R E S U E L V E:
- Primero. REVOCAR la sentencia de tutela proferida por el Juez
- Segundo. Civil del Circuito de Ibagué.
- Segundo. CONCEDER a los demandantes en este proceso la tutela transitoria de sus derechos a la vida y a la salud. En consecuencia, se ordena a los demandados cesar toda acción de daño o ruptura de las mangueras del acueducto que los miembros de la "Asociación del acueducto del Barrio Santa Cruz", han colocado en sus predios con el objeto de surtirse de agua en desarrollo de la respectiva concesión.
- Tercera.- Como quiera que la eventual imposición de la servidumbre de acueducto se hará por vía administrativa, la orden impartida a los demandados se mantendrá mientras se adopte la decisión definitiva por parte de La Corporación Autónoma Regional de Tolima. En caso de que no se imponga administrativamente la servidumbre, el amparo se mantendrá hasta que se adopte la respectiva decisión judicial.
