- PRIMERO. REVOCAR la decision del Juzgado Veintitres Penal del Circuito de Bogota, el 25 de noviembre de 2003 y en su lugar CONCEDER la tutela protegiendo los derechos a la salud en conexidad con la vida y a la seguridad social en favor de Nancy Rodriguez Cantor, por las razones expuestas en la parte motiva de este fallo.
- SEGUNDO. En consecuencia, se ORDENA al Instituto de los Seguros Sociales que en el termino de diez (10) dias, proceda a fijar la fecha para que se le realice la cirugia de reemplazo total de cadera a la senora Nancy Rodriguez Cantor.
- TERCERO. LIBRESE por Secretaria las comunicaciones de que trata el articulo 36 del Decreto 2591 de 1991, para los efectos alli contemplados.
