- Primero. REVOCAR el fallo proferido por la Corte Suprema de Justicia, Sala Laboral de fecha 21 de noviembre de 2001, mediante la cual se nego la proteccion solicitada por el senor Julio Henderson Villabon Chico. Y en su lugar, CONFIRMAR el fallo de primera instancia proferido por el Tribunal Superior, Sala Laboral de Ibague de fecha 10 de octubre 2001, en cuanto CONCEDIO el amparo de los derechos fundamentales a la vida y a la salud del accionante.
- Segundo. ORDENAR a la Secretaria de Salud del Departamento del Tolima que remita al senor Julio Villabon Chico a un hospital publico con quien tenga contrato vigente y de esta manera sea atendido en un termino de cuarenta y ocho (48) horas y se le entregue el medicamento ordenado o el que ordene el medico tratante. Si el precio del medicamento sobrepasa el correspondiente a los que figuran en el listado, el hospital publico que preste el servicio, repetira contra el FOSYGA.
- Tercero. LIBRESE por Secretaria las comunicaciones de que trata el articulo 36 del Decreto 2591 de 1991, para los efectos alli contemplados.
